Rules for better coexistence

House rules for tenants

Everyone wants to feel comfortable in their own four walls. This requires mutual understanding, consideration and helpfulness on the part of all residents. And it requires rules that apply to everyone.

As the property owner or manager, Baureform-Wohnstätte sets the rules that apply to everyone. The house rules are part of the usage or rental agreement and apply to flat owners, flatmates and visitors.

If the rules are not observed despite warnings, the tenancy agreement may be terminated by Baureform-Wohnstätte.

First point of contact: the property management company

The property management company is the first point of contact for any issues relating to the flat and the residential complex. The contact details of the responsible property management team are posted on the information board in the building entrance area and on our website www.brw.at. Instructions from the property management company and its representatives must be followed.

Rules, prohibitions and useful information for better living together:

1. Common areas and outdoor facilities

Please treat common areas, facilities and objects with the same care as if they were your personal property.

Only use lifts up to the specified maximum weight and use them as intended.

Do not leave and/or store personal belongings in the common areas.

Do not carry out any manual work in the stairwell.

Premises and other areas inside and outside the residential complex which are used but are not included in the object of use and have not been rented out constitute a loan for use (precarium) and must be vacated immediately upon request by the cooperative or the property management company. This applies in particular to storage rooms, corridors and stairwells, parking spaces, other outdoor areas and common areas in the underground car park.

 Announcements in the building and notices on the information board are only permitted with the consent of the cooperative.

2. Appearance

Furnish and plant loggias, balconies, terraces and private gardens in an attractive manner.

Obtain written permission from the cooperative before installing sun protection (e.g. awnings, external blinds).

The storage of rubbish and bulky waste on loggias, balconies, terraces and in private gardens is not permitted.

No plants are permitted outside windows, balconies, loggias, terraces or private gardens.

3. Noise and quiet hours

Observe quiet hours between 10 p.m. and 6 a.m. — normal room volume is permitted.

Avoid unnecessary or inappropriate noise (e.g. shouting, slamming doors) in general.

In the event of unavoidable temporary noise pollution (e.g. tradespeople in the flat), inform your  neighbours in advance.

There are designated areas for children to play in every residential complex. Please use these areas and observe the playground rules.

Playing and making noise in stairwells, attics, basements and other common areas is not permitted. Playing in green spaces is only allowed with express permission.

Parents must ensure that children can satisfy their natural urge to play and move around, while at the same time being considerate of the other residents. Normal noises from children playing outside of quiet hours must be tolerated by all residents.

4. Maintenance obligations and damage

Apartment owners are obliged to keep the apartment and associated areas such as private gardens, terraces, parking spaces, cellar compartments and the like clean and in good repair. In winter, associated open spaces must be kept free of snow.

Any gas convectors, gas boilers, decentralised living space ventilation units and apartment stations must be regularly maintained by the apartment owner.

Any damage must be reported to the cooperative. Failure to do so will result in the person responsible being held liable.

Tenants are liable for any damage caused by themselves, their flatmates or visitors to the building, outdoor facilities, the flat, general inventory or third parties. They are obliged to repair any damage at their own expense.

All tenants of the residential complex are jointly liable for the costs of damage whose cause cannot be determined.

When moving out of the flat, the flat owner must pay compensation for any missing or damaged items in the flat.

Baureform-Wohnstätte recommends taking out household insurance.

5. Damage caused by blockages

Only use all drain pipes in the kitchen, bathroom and toilet for non-oily liquids and use drain strainers where possible.

Only use the toilet for its intended purpose.

Do not pour food scraps, grease, hygiene products or any other solids that could cause blockages down the drains. Please note in particular that cat litter and similar products must not be disposed of in the toilet.

If a blockage occurs, the responsible property management team must be informed during office hours. Outside office hours, the emergency drain service listed on the information board in the entrance area must be contacted directly.

If it can be proven that a blockage was caused by a resident, the apartment owner is liable for damages.

6. Fire safety

The use of electric barbecues is permitted on balconies, loggias, terraces and in private gardens in accordance with local standards. Please maintain an appropriate minimum distance from the façade or other combustible objects and ensure that you are in good standing with your neighbours.

Lithium batteries, especially those used in mobile phones and e-scooters, should always be charged under supervision and with undamaged original accessories on a non-flammable surface.

All fire-hazardous activities are prohibited throughout the residential complex.

The storage of highly flammable substances is prohibited throughout the residential complex.

The storage of highly explosive objects is prohibited throughout the residential complex.

Barbecuing with an open flame is prohibited throughout the residential complex. Exception: private gardens with written permission from the property management company in compliance with the statutory safety regulations.

The use of emergency chimneys is not permitted. Exception: Order by the property management as a result of an emergency decree by the provincial governor.

The storage of fuels (wood), provided that the quantity exceeds the requirements for a few days, is only permitted in the cellar, whereby any official regulations must be observed.

7. Waste disposal

Separate waste properly, break down boxes and dispose of them regularly in the designated containers at the waste disposal area.

Observe the waste disposal area rules, keep waste disposal areas clean and always keep the lids of all waste containers closed.

Do not leave rubbish bags next to the bins.

The storage of bulky waste is prohibited in all areas of the residential complex.

In many municipalities, bulky waste is collected free of charge. Find out more!

8. Contamination

Any unusual dirt of any kind must be cleaned up without being asked by the person who caused it.

If unusual contamination is not removed, the occupant of the flat will be requested to remove it. If the request is not complied with, the cooperative will arrange for cleaning to be carried out at the occupant’s expense.

9. Water/waste water

Use cold water sparingly and take precautions to avoid any possibility of flooding.

Report damaged seals and leaking cisterns to the property management immediately.

Wet spots that indicate flooding or a burst pipe in a neighbouring room or in common areas, corridors and stairwells must be reported immediately to the building maintenance service, the property management company or, in case of imminent danger, to the emergency service of the water supply company or the responsible company listed on the emergency call list on the information board at the building entrance.

In the event of repairs to the water pipe or central heating systems, the duration of the water shut-off must be announced in advance in the building.

The person responsible for flooding is liable for any damage caused.

10. Mould prevention

All built-in furniture must have an air gap between the wall and the furniture.

Ventilate the flat regularly and heat it sufficiently during the cold season.

11. Laundry rooms and drying areas

Observe laundry room rules, keep laundry rooms and drying areas clean, follow the instructions for washing machines and dryers.

Only wash normally soiled laundry and follow general hygiene measures.

When doing laundry, be considerate of the needs of other residents. Remove laundry immediately after drying.

Any improper use of washing machines, dryers, laundry rooms and drying rooms is prohibited.

Drying outside the designated areas is not permitted.

Persons who do not live in the building are not permitted to use the laundry facilities.

Special arrangements are only permitted with the agreement of the building management. Any faults or damage to the facilities must be reported immediately to the building management or property management.

12. Parking of prams, bicycles, e-scooters and motor vehicles

Prams, bicycles and e-scooters may only be parked in the designated areas.

Only park motor vehicles in the designated parking spaces. Observe the markings and park your vehicle in a space-saving manner.

It is prohibited to park prams, bicycles, e-scooters and motor vehicles in courtyards, passageways and on pavements.

Leaving engines running is prohibited throughout the residential complex.

Motor vehicles may not be parked in the basement compartment or bicycle storage room.

If a parking space has been allocated to a specific flat, it may not be used by third parties.

13.Structural alterations

If you plan to make structural alterations to your flat, you must obtain the written consent of the cooperative in advance.

Structural alterations are all significant changes to the flat, in particular alterations to partition walls, laying of floors, alterations to gas, water and electrical installations and heating, replacing windows and making changes to existing chimney connections. Standard alterations are usually approved by the cooperative if they are carried out properly, comply with the latest technical standards, do not affect other residents and do not damage the building, in particular its external appearance.

In the case of unauthorised structural alterations, the cooperative is entitled to order the immediate restoration of the original condition. There is no entitlement to approval or compensation.

Upon moving out, the flat must be restored to its original condition. This is described in the handover report at the time of moving in. Any deviations can be agreed in writing. If changes are permanently attached to the building, they then become the property of Baureform-Wohnstätte. In this case, there is no entitlement to compensation unless this has been agreed in writing.

14. Installation of satellite systems, split air conditioning units and balcony power stations

The installation of satellite systems on balconies, loggias or the building façade is prohibited if the property has a communal antenna system or a cable connection.

If there is no communal antenna system or cable connection in the building, a declaration of consent must be obtained from the property management company for the installation of a satellite system. In this case, the installation must be carried out by a specialist company.

The installation of split air conditioning units and balcony power plants is only possible with the approval of the property management company and in compliance with mandatory requirements.

15. Apartment keys and handheld radio transmitters for underground car parks

Obtain permission from the property management company to have additional keys made for the apartment entrance door or to order an additional handheld radio transmitter for the underground car park.

Keys must not be left with persons who do not live in the building on a permanent basis.

The costs for additional keys or additional handheld transmitters shall be borne by the tenant.

When moving out of the flat, all house and flat keys as well as underground car park remote control transmitters must be returned. If keys are missing, the affected cylinders and key sets will be replaced for the new tenant. The costs will be deducted from the deposit or construction cost contribution.

16. Keeping pets

Small animals (guinea pigs, pet birds, pet fish, etc.) must be kept in suitable containers (cages, aquariums) in accordance with animal welfare regulations.

The express written permission of the cooperative must be obtained for the keeping of common pets (cats, dogs, etc.). The written consent of the house parties must be obtained in advance for the keeping of a dog.

Pets must be kept in such a way that other people or animals are not inconvenienced beyond a reasonable extent.

Any mess caused by pets must be cleaned up immediately by the pet owner.

Keeping dangerous animals as defined by the Upper Austrian Police Act, as well as animals that are not normally kept in homes or whose keeping is prohibited under species protection laws, is not permitted.

In principle, the keeping of common pets is permitted. No permit is required for the keeping of small animals.

Permission to keep large dogs and dogs of specific breeds will only be granted if all the requirements of the Upper Austrian Dog Ownership Act 2024 are demonstrably met. If a person – regardless of whether they have the necessary expertise, everyday suitability test or additional training – is unable to keep a dog in such a way that dangers or unreasonable nuisance to humans or animals are averted, no permit will be granted.

A permit that has been granted may be revoked if justified objections are raised by fellow residents.

In all residential complexes, dogs must be kept on a leash and wear a muzzle outside the home.

17. Other provisions

All residents must comply with the statutory registration requirements. The tenant must establish their main residence at the residential address for the entire duration of the tenancy.

Subletting the flat is only permitted in justified cases and with the written consent of the cooperative.

The exercise of any kind of commercial activity in the building is subject to the express written permission of the cooperative.

Keep front doors and doors to common areas (bicycle storage room, laundry room, basement, etc.) closed at all times.

Do not swap cellar compartments or parking spaces without authorisation.

The storage of foul-smelling items in the allocated basement compartments is prohibited without a suitable seal.

Beating or cleaning doormats, carpets, dusters and similar items is prohibited in the stairwells, from windows, loggias and balconies.

In case of imminent danger, authorised persons of the Baureform-Wohnstätte (e.g. property manager) are permitted to enter all premises of the building, including the flats. If the flat owner is not present in such a case, a public security guard will be called in. At the request of the cooperative (written resolution of the executive committee), the property manager or other authorised persons shall be granted access to the living quarters without giving reasons.

In those residential buildings and complexes of the cooperative where no house cleaning is carried out, the apartment owners are obliged to clean the stairwells and common areas jointly.

In those residential buildings and residential complexes of the cooperative where snow is not cleared, winter maintenance shall be carried out by the apartment owners in accordance with§ 93 (1) to (3) StVO.

These house rules have been adopted and issued by the cooperative’s executive committee. They may be supplemented, amended or revised at any time by resolution of the executive committee. The currently valid version can be found on the Baureform-Wohnstätte website at www.brw.at/hausordnung.

We would like to point out that the Upper Austrian Housing Promotion German Knowledge Ordinance 2020 is the basis for maintaining a subsidized apartment. By making the multilingual house rules available, we want to ensure that even those things that go beyond the A2 language level are understood by all tenants.
